Abdul Karim Hassan is a naturalized citizen who wishes to run for the Presidency of the United States. This even though the Constitution says “[n]o person except a natural born Citizen . . . shall be eligible to the Office of President.” Hassan v Scott Gessler, Colorado SoS
Business Insider reported on September 5, 2012, Abdul Karim Hassan’s series of lawsuits claiming his right to run for the Presidency have been denied in the Second, Third, and now Tenth Circuit Court of Appeals. A similar ruling was issued September 28, 2012 for the United States District Court for the District of Columbia.
The significance of these rulings cannot be underestimated as they affirm that the natural born citizen clause of Article II of the U.S. Constitution has not been trumped, abrogated, or implicitly repealed by the Equal Protection guarantee of the Fifth Amendment nor the citizenship clause of the Fourteenth Amendment. These arguments are the same ones used by Obama’s lawyers in fending off the legitimate challenges to Barack Obama’s candidacy and presidency; by the secretaries of state to refute ballot challenges, and by the media, pundits, Congress and the academics to cover up the usurpation of the presidency by Obama/Soetoro. Of course, the corrupt SCOTUS hears nothing, sees nothing, and says nothing.
Obama and his supporters, the Congressional eligibility deniers, and the media have been soundly defeated and Obama is still ineligible to hold or run for the office he seeks. What is more interesting is that the legal rulings lend support to the charges of misprision of felony that all members of Congress, and all the secretaries of state face in contributing to the overthrow of the White House.
This article briefly reviews the history of this case and its rulings.
The FEC Filing
Presidential Candidate Abdul Hassan ruled ineligible as he is not a natural born citizen
Hassan, a Guyana-born naturalized American citizen, filed papers with the Federal Election Commission to run for the presidency. Astoundingly, the FEC ruled in September 2011 that Hassan could file papers and raise money to run for president of the United States:
But the agency also told the prospective candidate, Abdul Hassan, that his campaign may not receive federal matching funds because he was not born in America. However, the agency’s decision stopped short of addressing the constitutional issue of whether someone born outside the United States can be president.
Importantly, the FEC made clear that it was outside it’s jurisdiction to decide the constitutional merits of Mr. Hassan’s candidacy, saying that vetting was up to the States:
“This does not mean that he can go and say ‘look the FEC has said that I am a candidate, give me money, I’m official,’” said Republican Commissioner Donald McGahn. “That is not what we do here; we don’t certify you as a candidate. That’s what the states do.” (emphasis added)
Democratic FEC Commissioners had ‘trepidation’ in issuing this unanimous opinion because of how it might be perceived. They attempted to qualify and explain their rationale:
“By saying that it is okay — it does give the impression that we don’t see a problem,” said Democratic Commissioner Steven Walther. “I think that we really need to be cognizant of how this could be misconstrued.”
To address this problem, one of the final sections added to approved opinion states:
“Notwithstanding this conclusion, the Commission expresses no opinion on Mr. Hassan’s potential liability arising out of his proposed activities under any other Federal or State law, including any laws concerning fraudulent misrepresentation. Any such issues are outside the Commission’s jurisdiction.”
“For us this is really all about what we are empowered to decide and what we are not empowered to decide,” said Democratic Commissioner Ellen Weintraub. “Nobody is saying that it is fine and nobody is saying it’s okay for this guy to be going out and raising funds.’”
Ballot Access Denied in Colorado, New Hampshire
Hassan then proceeded to set up a website and attempted to get on the ballot in New Hampshire and Colorado. When denied access by both Secretaries of State of each state, he sued. He has filed five lawsuits which argued that:
… the Constitution’s natural-born-citizen requirement is a vestige of our less noble past, before we decided that discrimination based on national origin is a grievous wrong. (He points in his briefs to Dred Scott v. Sandford.)The lawsuits say the Constitution’s admonition that “[n]o person except a natural born Citizen . . . shall be eligible to the Office of President” violates the Equal Protection Clause of the 14th Amendment.
Hassan’s lawsuits have already been denied in the First and Second U.S. court of appeals. And the Tenth Circuit rounded out the trio on Tuesday when it too shut down Hassan’s case.
Hassan initiated other lawsuits aimed at the natural born citizen requirement based on these assumptions, and filed against the Presidential Election Campaign Fund Act (26 U.S.C. §§ 9001-9013) which provides public funding to Presidential nominees of major or minor political parties after the FEC issued an advisory opinion that Hassan did not qualify for any matching funding because he was not a natural born citizen. Hassan argues that the Presidential Campaign Fund Act is:
(1) unconstitutional and invalid, and (2) the natural born citizen clause of the Constitution1 is irreconcilable with, and has been“trumped, abrogated and implicitly repealed” by, the Equal Protection guarantee of the Fifth Amendment and the Citizenship Clause of the Fourteenth Amendment.
Now this is where it gets interesting. The FEC as defendant submitted a motion to dismiss the case based on the same premises that have been used to try to defeat challenges to Obama’s eligibility. That is,
Pending before the Court is Defendant’s Motion to Dismiss for lack of jurisdiction under Rule 12(b)(1), or in the alternative, for failure to state a claim under Rule 12(b)(6) of the Federal Rules of Civil Procedure. (emphasis added)
The FEC also argued that Defendant argued that this Court should deny Plaintiff’s Application because
the Complaint fails to present an Article III case or controversy, and alternatively, because it does not present a substantial constitutional question. (emphasis added)
The government moved to dismiss the case–using the same arguments it has used to dismiss other cases against Obama–(1) failure to present a claim upon which relief can be granted, (2) lack of jurisdiction, (3) failing to present an Article III case or controversy, and (4) failure to present a substantial constitutional question.
The one argument missing from the government’s defense? STANDING.
American Jurisprudence and Constitutional Legal Thinking
The DC circuit court dismissed Abdul Hassan’s case. The judge’s ruling denying Abdul Hassans suit against the FEC is illustrative for the process the Judge followed in making its conclusions. As opposed to ducking jurisdiction and ducking its Article III responsibility to hear cases involving constitutional questions, the court determined:
Because subject matter jurisdiction focuses on the court’s power to hear the claim, however, the court must give the plaintiff’s factual allegations closer scrutiny when resolving a Rule 12(b)(1) motion than would be required for a Rule 12(b)(6) motion. Macharia v. United States, 334 F.3d 61, 67-68 (D.C. Cir. 2003). Thus, to determine whether it has jurisdiction over a claim, the court may consider materials outside the pleadings where necessary to resolve disputed jurisdictional facts. Herbert v. Nat’l Acad. of Scis., 974 F.2d 192, 197 (D.C. Cir. 1992). (emphasis added)
Regarding FRCP Rule 12 (b), the court determined:
A court need not, however, “accept inferences drawn by plaintiffs if such inferences are unsupported by the facts set out in the complaint. Nor must the court accept legal conclusions cast in the form of factual allegations.” Id. In addition,“[t]hreadbare recitals of the elements of a cause of action, supported by mere conclusory statements, do not suffice.” (emphasis added)
In other words, the Court actually took on the issue, was legally entitled to review additional information, and ruled it did not have to accept inferences or ‘legal conclusions cast in the form of factual allegations’. Every one of the Obama challenge cases was thrown out first, on standing, and second, using the measly excuses such as failure to present a case, lack of Article III jurisdiction, or the ‘political question’.
Article II Still Stands
I hope everyone who has been involved in the eligibility movement can appreciate the significance of these rulings for the Constitution, the requirements of the Presidency, and all the work we have accomplished over the last several years. It is critical to inform your friends who are skeptical of the ‘birthers’ or disappointed in the perceived failure of the 100+ cases challenging Obama that several courts have affirmed the natural born citizen requirement of the presidency–that it still stands, and that we are right and always have been on this issue.
Significantly the FEC believes the States are responsible for the determination of eligibility, just as the Article II Superpac, the Obama Ballot Challenge, the extensive legal work of many scholars, and many, many others have indicated. The 2009 Continental Congress recommended vetting laws at the state level were required, and the Article II Superpac will continue its efforts after this election and into 2013 to ensure a vetting process is in place at multiple levels, to make sure the usurpation of the White House by an unknown, unvetted foreign national never happens again.

Did Hassan do us a favor, or did we just have some good judges for a change? Why did these judges have courage and the others have not?
Long and short of it:
NO 14th amendment (naturalized aka statutory) citizen is a natural born citizen.
One approach that was never pursued, because it piques absurdity but is valid: Hawaii avoided and never certified Obama’s birth-DATE in CO; i.e. if one “argues” for the sake of illumination that perhaps he was born before 1787, then if so he would be eligible for president — but if he was born after 1787 he is ineligible.
It was always that raw distinction between “Citizen” and “natural born citizen” that proved he was ineligible, just based on the grandfather clause of Article II and the contrast between Article I’s requirement for Congress/Senate vs. Article II’s requirement for POTUS. And in terms of his Senate eligibility he needed to be a “Citizen” for 9 years; the retort would be yes, of course he was a Citizen for over 9 years, he was a Citizen since his “birth” in Hawaii thus meeting Article I’s requirement — but does being a “Citizen” even since birth, meet Article II’s requirement? Since the 14th does not cover Article II, and the 14th describes several citizens-at-birth but does NOT describe a 2-US Citizen parents/born in USA natural born citizen at all, which is the ONLY permutation missing (from the 14th and current law), this is obviously the only possible definition of a natural born citizen, which Obama fails. It’s just math.
This Hassan dude thought he could ride the Hollywood sharia-compliant ignoramus lefty-anti-American do-nothing-about-clear-usurper Obama sentiments into sticking his foot in the door for other foreigners like himself, maybe collecting some campaign cash, mostly from fellow musloids, or to open the door for others like him to replace Obama.
Do you notice on ALL federal forms you are only given the option of “Citizen” or “resident alien” or some other contrast, when in actuality there should be two categories of Citizen: Statutory/Naturalized or Natural Born Citizen.
The judges were saying, “we let Obama in, but no more foreigners”…I wonder if they realized it was better not to open the floodgates to more Obama-like-foreigners and put some meaning back into Article II.
Hassan is just a statutory naturalized citizen thus ineligible. Obama is a US Code 1401 naturalized-at-birth statutory citizen, thus ineligible.

I did go to his web site and will say that I did enjoy his legal ease. It did ring with a lot of truth that has a good chance of winning in the right…er…a court that is supportive of a constitutional change for vetting. But then no one is vetting anyway so what does it really matter. They said he could run…so why not go ahead and run then make all the noise he can for popular support…just like BO did. Congress/Senate are either complicit or cowed, but in all cases they all know he’s ineligible and should face consequences, which history will NEVER ignore. The courts are not in the tank for Hassan like they are for Obama. And he can’t deny that he was born in another country, whereas Obama has insisted that he was born in Hawaii. Of course, we all know that is not even the issue here. Do these judges have a better grip on what the founding fathers meant by natural born citizen? I don’t think they probably do. Hassan obviously doesn’t have big money and big names behind him where the usurper does.

Florida Supreme Court decisions also support the premiss that the states decide who is eligible.
“Eligibility for office is a judicial determination upon any challenge properly made”. (Shevin v. Stone (1972)).
Obama’s lawyers have claimed that eligibility for POTUS is a “political question”, i.e one determined by a “sovereign” (branch of government) in the fulfillment of its constitutional duties. Thus they say that the 20th Amendment, and the electoral college (US Code 3 s. 15) provide the process for determinining eligibility.
However, the 20th Amendment only provides the succession process AFTER the determination of “failure to qualify”. US Code 3 S. 15 (the Congressional statute for the operation of the electoral college) provides no process fopr determining eligibility, only that the electors may “submit objections”, and does not specify what those objections may be.
Further, it has been well held in SCOTUS that the electors are NOT members of the government, and are agents of the states (SEE Mcpherson v. Blacker (pg. 35), and Fitzgerald v. Green (pg. 178)).
My case is on appeal making these very same points that the Hassan case supports—- eligibility is a state determination.
By the way, A2S1C4 is a self operating. No statutory provision is necessary to enforce it. The obama lawyers’ contention that the “state SOSs have no duty to determine eligibility” is of no consequence.

Of course he must then only have to prove that he became a naturalized citizen because he sure cannot prove that he is a “Natural born citizen”.

The only problem with this story is that the Judge fails to define EXACTLY what is a NBC. Most Judges are convinced that a U.S. citizen and a NBC are one and the same…which we KNOW is NOT TRUE.
ALL NBCs are U.S. citizens…but NOT ALL U.S. citizens are Natural Born Citizens.
Such are the cases concerning Sen. Marco Rubio AND now we learn of former Sen. Rick Santorum. BOTH their parentS were NOT U.S. citizens when they were born here in the USA.

The law on the books US Code 1401 is derived from the 14th amendment, and it lists a one-US-Citizen parent/child born on US soil permutation as a statutory or naturalized-at-birth citizen…therefore not a natural born citizen, since no US Code 1401 citizen is a natural born citizen. Even former, freed slaves, the first generation after 1868 which were counted as citizens based on the 14th, were not counted as natural born citizens, since their parents were country-less, non-US Citizens, as the 14th was not retroactive.
And what of the CRA1866? It’s an active, non-overturned, Act of Congress …remember the 14th was added in 1868 and the laws relating to the 14th have been added since. CRA1866 was passed twice, again in 1870.
It says: “That all persons born in the United States and not subject to any foreign power…are declared to be citizens of the United States.”
So per this law the only persons who were obviously “natural born citizens” were those with parents who had US Citizenship.
US law does not even recognize dual citizenship, the naturalization oath attests to this…all who are US Citizens must abjure all other citizenships. And so even if a parent had “dual” citizenship — as in slapped on by another country due to their own laws, as long as that person still has US Citizenship, which is not lost unless actively revoked by an adult competent person at a consulate…as long as that person has US Citizenship at all, that fundamentally is all US law sees as of any meaning.

Look at the laws: the only omitted permutation of finite permutations is “born incountry of citizen parents”…it’s just math.

What Do the Words F*ck and Racist Have In Common?
The two most over used words in America today are—racist and F*ck. There once was a time both of them had real power. Now they are so common they have lost their usefulness and it suggests those who use them have limited vocabularies and maybe even limited minds.
I am rather disappointed over that. Once upon a time “f*ck” had bite, punch and shock power. I mean the mere sound of the f-word at a ladies high social would cause them to spill their tea on themselves. Security would be called and the offender was sternly orderded to cease and desist or face a severe alternative. No decent woman would be caught using that word even when she was doing it. Then movie producers found out it increased box office tickets. From then forward its use became so common in the movies, by stand-up comedians, house wives, mothers and teen agers it lost its power. I for one am sorry to see that word’s demise into the no big deal class. Try shouting f*ck at a tea party today and they are liable to shout back “f-u”. I can no longer use the f-word to convince people I’m a bad ass.
Martin Luther King brought the use of the word “racist” into play in the 60’s. Yes, there plenty of RACISTS, then. I was happy to see American blacks excel in every type career from teaching, medicine, law, entertainment, movie production, golf, and all sports, politics to art and more. Gradually and steadily the differences between black and white were dissipating. We were working together as citizens of America.
That is not to say there are no more white racists in America since then. It is also not to say there are no racists among blacks. There are plenty in all people. However the numbers of hard core bigots had significantly decreased to a minority until the queen of black racism stepped forward—Michelle Evita Obama. Bringing back the idea of racism and dividing America was a major part of Sotoero’s campaign strategy in 2008. Repeatedly attacking people with The word “RACIST” became the whip they repeatedly used when anyone objected to any of Obama’s policies. From the beginning of Barry’s campaign to the present, we heard the word “RACIST” more times than we did the in the combined total of the past 20 years. Like the word “f*ck” the word “racist” has been used to describe anything from sex, anger, frustration, stupidity or simply to discredit any valid point the attacker has no intellectual rebuttal. They literally used the white American’s fear of being LABELED RACIST into forcing America into voting for a pretend to be black man. IT WAS HISTORICAL THEY REPEATED. THIS IS OUR CHANCE TO HAVE OUR FIRST BLACK PRESIDENT. OUR CHANCE TO SHOW THE WORLD AMERICA IS NOT RACIST. Let us not forget—Obama is also half Caucasian.

A farming family in Letha, Idaho recently had their house raided and were assaulted by police after a neighbor called the police when overhearing a verbal argument between the husband and wife who owned the house. In any other situation they would have had a simple knock on their door and the police would check in to make sure that no one was being hurt.
However, Marcella Cruz and Michael Gibbons were flagged in the police department’s database as dangerous individuals because one or both of them identified as “constitutionalists”. Due to this identification their simple domestic disturbance call was met with a full on swat raid, with the officers scouring the house for evidence of Marijuana.
The officers ripped Marcella Cruz out of the house, and had both her and Michael on the ground in handcuffs, with guns against their heads. The police found an aquaponics system that was growing tomatoes in an upstairs room of the house and celebrated, thinking that they had found a Marijuana grow operation. Much to their disappointment they were informed that it was obviously tomatoes, since after all, this was a farm house.
In a recording that surfaced after the raid it is explicitly stated that this couple is being targeted because of their political beliefs. The recording shows the following exchange:
“Are you familiar with these guys?” asked a deputy identified in the 911 recordings as “Officer 57.”
“Negative,” answered another deputy designated “Officer 56.”
“I am, and it’s affirmative, there is [sic] weapons,” continued Officer 57. “He is – or at least was – anti-law enforcement. We’ve had issues with him. He’s a Constitutionalist.”

Biden was a disgrace to himself, to the Dems and America last night. He was out of control, angry, hostile, and out classed. His continuous Chesser cat grin and laughter was so out of place it suggested insanity while on the verge of a nervous breakdown. His actions were of a man who was told–”You better win this debate, or else.”
Biden’s perfomance last night may well be a fore funner of what we can expect from B. Hussein next Tuesday. Barry and his cabal are beaten–defeated. They more so than anyone know they CANNOT WIN THIS ELECTION UNLESS THEY RESORT TO EVERY BIT OF ELECTION FRAUD THEY CAN GET AWAY WITH. Biden’s actions in that debate were that of a very frightened man. He was fighting for his political life!

Mike Huckabee interviewed Dick Morris this morning. Aside from the opinion on last night’s debate (that Ryan should have been more aggressive, calling the Benghasi affair a cover up and outright lie by the administration), Dick brought up a very interesting point. How O will tax the US, even if he loses the election, thought the UN.

The results came in a groundbreaking scientific poll for WND by the public-opinion research and media consulting company Wenzel Strategies. It was taken Oct. 22-26 and carries a margin of error of plus or minus 3.98 percentage points.
The poll also found 40 percent of Muslims in America believe they should not be judged by U.S. law and the Constitution, but by Shariah standards.
And the big winner among Muslim-Americans in the presidential election is Barack Obama, the poll found. More than 72 percent said they are definitely supporting Obama, and another 8.5 percent are leaning that direction. Only 11 percent are for Romney.
Nearly 55 percent of the American Muslim voters say the U.S. is on the right track, and another 13 percent are uncertain. Virtually all of the respondents (98 percent) are American citizens and 97 percent are registered to vote.
Not so many years ago there used to be a common saying in the USA. You’ can’t legislate morality. Although we have freedom to practice ones religion in this country, its not entirely free as the secular laws can;t be broken. We used to be taught the following a an example. Ones church or faith may not recognize a divorce,, but the govt does if one gets a civil divorce in court. We have unleashed something here and it has to be stopped. All kinds of groups think they can just secede from the rule of law of the nation and states. one can get kicked out of a faith for breaking their rules, but the civil society accepts you.
If one ants to live in the USA and be a citizen, etc. then one follows the laws of the land. In a free society, there are not going to be many rules restricting personal behavior. One may think someone;s behavior is leading straight to damnation from their faith perspective, a;Freedom of speech gives us the right to say something, but the person can say leave me alone, too. Its called free will and freedom. We don’t have to agree with everyone’s life styles, etc. but to but each needs to know if they want to live a certain way, they can do so as long as the laws of the country are not violated.
as for the persona of being a Muslim, its part of the election for the Sec Gen of UN. There is much bigger campaign going on here. Main media knows the truth and they just decided to hide it.
