Caught in a Lie

Washington, D.C., Jan. 25.  Mr. Barry Soetoro, aka Barack Hussein Obama, was allowed to give the U.S. State of the Union Address (SOTU) for the third year in a row despite the now common knowledge that Mr. Hussein-Soetoro is an undocumented foreigner residing temporarily in and occupying the White House. Soetoro-Obama is an admitted dual citizen at birth thus failing the ‘natural born citizen’  requirement of the U.S. Constitution Article II, Section 1, Clause 5.

Having been elected through massive fraud, the wasted fervent dreams of the left, the now defunct and discredited mainstream media’s willing collaboration, and an influx of close to $1 billion in foreign donations, Mr. Hussein-Obama bankrupted America in his first two years of impersonating the Commander in Chief in order to repay his campaign debt and creditors.  Foreign policy, trade, and treaty-making were also used to curry favor with benefactors or those other Nations who knew of  Mr. Soetoro’s non-U.S. foreign status.

Taking the podium for what appears to be his last time as the poseur pResident of the United States in light of the evidence amassing against him, Mr. Soetoro heaped praise upon foreign nations, Muslims, and the global community but failed to mention one positive achievement of the United States.  The audience sat in tepid response, as Mr. Obama confirmed his stunning foreignness for the viewing national audience, repeating the same phrases and ideas now viewed more as a threat to America’s existence than a promise of stability.

Reminding America of how important he is, the Obama-Soetoro-Hussein strode out of the hall like a rooster…trying to look cool but with his nuts privates in a vice.  Luckily for him he was apparently surrounded by chickens.

It was an audacious display of arrogance in the face of criminality as millions of people were complaining to their Congressman throughout the SOTU by texting their cell phones, “Born a Brit, Not Legit!”

      President Obama was born in the state of Hawaii, and is therefore a natural born citizen of the United States of America. It does not matter if his father was a British subject at the time or not: Obama was born an American.

          Heather – please give me sources – any sources (but real ones, not Michael Norris or Mario Apuzzo or any other crackpot using Vattel and translating French very badly) – from a textbook, or any primary source for you assertion. Because in 12 years of lower schooling, 4 years of college studying history and then grad school studying constitutional history and law, I never once encountered the unique “birther” claims. Nor did I ever encounter Vattel except when we did an admiralty case.

          PS – Did you know Vattel also thought that only Lords should have weapons and that if a country didn’t have enough women, it was perfectly fine to go steal another country’s women – but only the hot ones.

    Jay Inslee says that since all the first presidents were British subjects, and since Britain can’t dictate who can be our president, that it doesn’t matter that Obama was born British. He also says that supreme court precedents don’t matter, and are overriden by cases being denied, and that such denials are de-facto modern court rulings.

    I would like Mario Apuzzo’s take on this “new” approach!!

    I would remind Congressman Inslee that the founders renounced their British citizenship along with the Declaration of Independence, they fought a WAR against Britain, and the GRANDFATHER CLAUSE allowed the first presidents to not be second generation pure Americans.
    I would also remind him that SCOTUS precedents are not overruled by bogus denials of standing and such.

        Of course they cannot differentiate between the terms “citizen”, “native citizen”, “native born citizen”, etc. and the term of art used in the US Constitution – “natural born Citizen”. The term in the Constitution has a specific meaning which is approached by NONE of the others else one of those other terms would have been used in that document.

        Even so, were they able to define their own meaning of the term it would be completely meaningless since they have no legal force in interpreting the meaning of Constitutional wording. Only the Supreme Court has that charter. Any other entity’s definity would be legally meaningless as it would allow the clear override of the Constitution which can only be done in the prescribed form of a Constitutional Amendment.

      I used to think the so called “grandfather clause” of Article 2, Section 1, Clause 5 of the Constitution had no relevance for today considering that we are 224 year into the future past the time of the adoption of the Constitution, however now, in my opinion, thinking in that way diminishes the real brilliance of the Founders in writing that qualification for the Office of the President in the way that they did.

      No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.

      Directly Stated:

      1) No person except a natural born Citizen shall be eligible to the Office of President.

      2) A Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of the President.

      Indirectly Stated:

      3) A Citizen of the United States, after the time of the Adoption of this Constitution, shall not be eligible to the Office of the President, except they shall be a natural born Citizen.

      The Founders told us who can qualify for the Office of the President, without defining the special subset of Citizens of the United States, they knew and understood to be natural born Citizens.

      The writers of the Fourteenth Amendment knew and understood what the Founders defined natural born Citizen as because they stated:

      Sen. Lyman Trumbull, Chairman of the Judiciary Committee, author of the Thirteenth Amendment, and the one who inserted the phrase:

      [T]he provision is, that ‘all persons born in the United States, and subject to the jurisdiction thereof, are citizens.’ That means ‘subject to the complete jurisdiction thereof.’ What do we mean by ‘complete jurisdiction thereof?’ Not owing allegiance to anybody else. That is what it means.

      Sen. Howard concurs with Trumbull’s construction:

      Mr. HOWARD: I concur entirely with the honorable Senator from Illinois [Trumbull], in holding that the word “jurisdiction,” as here employed, ought to be construed so as to imply a full and complete jurisdiction on the part of the United States, whether exercised by Congress, by the executive, or by the judicial department; that is to say, the same jurisdiction in extent and quality as applies to every citizen of the United States now.[3]

      Sen. Johnson, speaking on the Senate floor, offers his comments and understanding of the proposed new amendment to the constitution:

      [Now], all this amendment [citizenship clause] provides is, that all persons born in the United States and not subject to some foreign Power–for that, no doubt, is the meaning of the committee who have brought the matter before us–shall be considered as citizens of the United States. That would seem to be not only a wise but a necessary provision. If there are to be citizens of the United States there should be some certain definition of what citizenship is, what has created the character of citizen as between himself and the United States, and the amendment says that citizenship may depend upon birth, and I know of no better way to give rise to citizenship than the fact of birth within the territory of the United States, born to parents who at the time were subject to the authority of the United States.[4]

      No doubt in the Senate as to what the citizenship clause means as further evidenced by Sen. W. Williams:

      In one sense, all persons born within the geographical limits of the United States are subject to the jurisdiction of the United States, but they are not subject to the jurisdiction of the United States in every sense. Take the child of an ambassador. In one sense, that child born in the United States is subject to the jurisdiction of the United States, because if that child commits the crime of murder, or commits any other crime against the laws of the country, to a certain extent he is subject to the jurisdiction of the United States, but not in every respect; and so with these Indians. All persons living within a judicial district may be said, in one sense, to be subject to the jurisdiction of the court in that district, but they are not in every sense subject to the jurisdiction of the court until they are brought, by proper process, within the reach of the power of the court. I understand the words here, ‘subject to the jurisdiction of the United States,’ to mean fully and completely subject to the jurisdiction of the United States.[5]

      Rep. John Bingham of Ohio, considered the father of the Fourteenth Amendment, confirms the understanding and construction the framers used in regards to birthright and jurisdiction while speaking on civil rights of citizens in the House on March 9, 1866:

      [I] find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen…[6]

    Dr. K, another fantastic article.
    How sad that was his third time there. How sad the dems kept standing every time he opened his mouth.
    How very sad that his being there has caused so much pain to so many lives. He has accumulated more bodies, I think, than the Clintons did.
    I thought it was cool that Gifford’s husband turned down the opportunity to be there.
    It was great that there were some missing Justices.
    It was fun watching the frowns on the Military Generals or whatever rank they have, they did not look pleased at all.

    The texting was a great idea.

    Don’t all of the Congress have web sites or text or facebook?
    We should use the venue to each morning, send a message, Born a Brit, Not Legit, after a week or so it should be burned in to the subconscious. Then after a couple of weeks, start leaving a message of, come clean before it’s too late, or speak up or go down with the others. And every two weeks, go back to the first one, keep them moving and everyone on the same page each week.

    What say the rest of you? Think it will work or no?

    The best part of the ghost president’s speech last night is that most of America did not buy it. What O’ghost says and what O’Ghost does are two different items and we know it.

    All the king’s David Plouffs and all the king’s Axelrods will never put O’Ghost back together again. All the king’s people will never put him back into the WH. Lame stream media can keep repeating that poison apples are good but no one is taking a bite any more.

And while I acknowledge that even some conservative pundits have joined the left-wing knuckleheads in dismissing a certain number of patriots as “birthers,” the fact remains that the Founding Fathers wouldn’t have stipulated prerequisites to being president if they hadn’t thought it mattered.

    The good news for liberals is that even though nobody has been able to turn up the official document, they have sworn testimony by several people who just happened to have been in the Honolulu delivery room on Aug. 4, 1961. They include Rahm Emanuel, Harry Reid, Van Jones, Valerie Jarrett, Henry Waxman, Bill Maher and Chris Matthews. The attending physician was Dr. Keith Olbermann, and the head nurse was Nancy Pelosi.

It was called their Stimulus plan – which by the way – only strapped us with even more deficit spending.”

The indices reflect data through November and show a deceleration in the annual growth of home prices nationally and in 17 of the 20 metropolitan statistical areas (MSAs) that create its indices.

    S&P/Case-Shiller analyzes its national sample of 20 MSAs individually and uses them to construct a 10- and a 20-City Composite Index. Both indices fell in November from October levels by 0.4 percent and 1.6 percent respectively and prices fell in 19 of the MSAs; only San Diego eked out a negligible 0.1 percent gain.

    The report states that “since May 2010, the housing market has experienced an unambiguous deceleration in home price returns.” The 10-City Composite has reentered negative territory with a -0.4 percent annual growth rate in November compared to a +5.4 percent rate reported in May. The 20-City Composite fell 1.6 percent in November compared to a 4.6 percent growth rate in May.

    In a speech that “was mostly talk,” the most disturbing part for the New York-based developer was the president’s decision to praise technological and business advances in China, long an economic nemesis for the US.

    “I thought the low point was when he talked about how great China was,” Trump said in a CNBC interview. “To me that was inappropriate to have in this speech, especially in light of what has happened with China.”

    The president singled out China for the advances it made in education and held the nation up as an example for what the US should be doing.

    “Meanwhile, nations like China and India realized that with some changes of their own, they could compete in this new world,” Obama said. “And so they started educating their children earlier and longer, with greater emphasis on math and science.

    “They’re investing in research and new technologies. Just recently, China became home to the world’s largest private solar research facility and the world’s fastest computer.”

During the visit, Obama praised China for making progress on human rights and said the two nations should strive for an environment of “cooperation” and “friendly competition.”

    For Trump, though, the president’s posture is symptomatic of the raw deal the US is getting with its international trading partners.

    “I understand the Chinese, and I understand they are not a friend of this country,” he said.

    “We had this tremendous deficit with China last year and we had that with many other countries. We can’t be doing that,” he later added. “We have become a whipping post for many of the smart countries of the world.”

          There is a typed print out where barky’s name is entered on a registry and the person before him has is named Mae Osomething – I forget- and the word Duplicate appears as part of her full name…. sorry for the confusion. Ladyforest did a lot of work and went through a lot to get photos of records, etc…

          so sorry to confuse the issue.

              Actually it’s been established that not every birth that occurred in HI was announced in the papers. I think it works out to somewhere around 2/3’s of them were.

              When I checked the Jan and Fed 1961 “marriage/lic-marriage announcements, I saw a bunch of names from the same time frame (11 days) that I used to do the newspaper comparison – frequency of the two papers posting the exact same birth list in exact same order- around the date obama was announced.

    According to the law enacted by the 1st Congress, session II, Ch. 4, whether he was born in the State of Hawaii or not, he is ineligible to run for, or be elected to, the office of President of the United States because the law stated” “…the children of citizens (both parents) of the United States, shall be considered natural born citizens; provided that the right of citizenship shall not descend to persons whose fathers have never been resident in the United States: provided also, that no person heretofore proscribed by any State, shall be admitted a citizen as aforesaid, except by an act of the legislature of that State in which such a person was proscribed. (a) Approved, March 26, 1790.” What does that mean? It means the father must be a citizen to transmit citizenship to a child of his seed who was born in this country. If he is a natural born citizen, he will transmit that right to his offspring. If he is a naturalized citizen, he transmits that right. He cannot transmit a right he does not possess. Thus, if he is not a citizen of the United States, he cannot transmit citizenship rights of any type to his offspring since he has none to bequeath. Which means any illegal alien cannot transmit US citizenship rights to an illegal offspring since they lack citizenship. The parents, and their US-born offspring are legally subject to deportation.

    AUSTIN, Texas — Texas environmental regulators on Wednesday approved a crucial air quality permit that paves the way for construction of a coal-fired power plant in Corpus Christi, defying a request by the U.S. Environmental Protection Agency to deny the permit.

    The three-person Texas Commission on Environmental Quality voted 2-0 to approve the permit for the planned Las Brisas Energy Center, with a few minor modifications. Commissioner Carlos Rubinstein abstained from voting due to being briefed on the permit when he previously served as deputy executive director.

    The permit’s approval marked the latest chapter in a feud between the state commission and the EPA. The EPA has taken over parts of Texas’ permitting authority because the state refused to comply with federal demands, and Texas filed several lawsuits challenging EPA rules, insisting they are inefficient, don’t benefit the environment and harm industry.

        I spoke to Issa’s rep today, he gave the hypothetical situation…well let’s assume he is ineligible, the fallout would be catastrophic, and we are being “heard” (cited Arizona’s new law), as if these should placate the barbarians at the gate (us, the unwashed masses)…I told him this precedent cannot be allowed to stand, that the definition of natural born Citizen needs to be put out strongly, and yet and I have to say, this is a first breath of honesty I’ve ever ever heard…and I didn’t want to devolve into the manifestations of this usurpation, they are TOO OMINOUS.

        I didn’t want to not show my appreciation for this level of honesty because it’s totally a FIRST. He said, “you probably have your own website or something” (I don’t I’m just a concerned parent/American) and he agreed that most Americans are into their Cheetos and American Idol…I was flabbergasted at even this level of common sense and decency, though he did sort of sound patronizing when he offered that I could call whenever I wanted to vent.


        I don’t want to vent, I want solutions, damnit. I want my country back. I even want a black GOP president just so’s I can rub their faces in it.

        Jeez…it was interesting though. The front page Drudge story really took the air out of their tires a bit, and you know they LIVE by polls and the media. And say, to those reading this, over 60% of Americans did not believe Obama was born in the USA and that was BEFORE the Abercrombie story! On Yahoo the bloggers are saying Abercrombie’s friend must’ve been threatened to change his tune 180 degrees in 1 day–they “get it”. There’s a pall cast on the anti-birther/fraudsters.

    I STRONGLY suggest you all call your reps and politely ask them to differentiate a Citizen from a Natural Born Citizen based on article II (there were no oath naturalized citizens until well after the Constitution).
    The ANSWER is that Citizen means a first generation citizen like the founders, who had relinquished their British citizenship, fought a war, and declared independence and that a Natural Born Citizen is a second generation citizen with NO first generation ties by blood or soil to a foreign nation.

    There just is no other answer, it’s embedded in to article II via the grandfather clause.

    Then add the layer on top that there is no birth certificate.

    THEN they might just start talking, and we would like to know what your rep says. You report, we decide! (Hey I like that, catchy!!)

    A bill filed for the Texas Legislature by Rep. Leo Berman, R-Tyler, that would require candidates’ documentation.

    Berman’s legislation, House Bill 295, is brief and simple:

    It would add to the state election code the provision: “The secretary of state may not certify the name of a candidate for president or vice-president unless the candidate has presented the candidate’s original birth certificate indicating that the person is a natural-born United States citizen.”

    It includes an effective date of Sept. 1, 2011, in time for 2012 presidential campaigning.

    Berman told WND he’s seen neither evidence nor indication that Obama qualifies under the Constitution’s requirement that a president be a “natural-born citizen.”

    “If the federal government is not going to vet these people, like they vetted John McCain, we’ll do it in our state,” he said.

    He noted the Senate’s investigation into McCain because of the Republican senator’s birth in Panama to military parents.

    At the time the Constitution was written, many analysts agree, a “natural born citizen” was considered to be a citizen born of two citizen parents. If that indeed is correct, Obama never would have been qualified to be president, as he himself has confirmed his father was a Kenyan subject to the jurisdiction of the United Kingdom, making Obama a dual citizen with Kenyan and American parentage at his birth.

    Other definitions have called for a “natural born citizen” to be born of citizen parents inside the nation.

    There have been dozens of lawsuits and challenges over the fact that Obama’s “natural born citizen” status never has been documented. The “certification of live birth” his campaign posted online is a document that Hawaii has made available to those not born in the state.

    The controversy stems from the Constitution, Article 2, Section 1, which states, “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.”

    The challenges to Obama’s eligibility allege he does not qualify because he was not born in Hawaii in 1961 as he claims, or that he fails to qualify because he was a dual citizen, through his father, of the U.S. and the United Kingdom’s Kenyan terroritory when he was born and the framers of the Constitution specifically excluded dual citizens from eligibility.

    There are several cases still pending before the courts over Obama’s eligibility. Those cases, however, almost all have been facing hurdles created by the courts’ interpretation of “standing,” meaning someone who is being or could be harmed by the situation. The courts have decided almost unanimously that an individual taxpayer faces no damages different from other taxpayers, therefore doesn’t have standing. Judges even have ruled that other presidential candidates are in that position.

    The result is that none of the court cases to date has reached the level of discovery, through which Obama’s birth documentation could be brought into court.

    Obama even continued to withhold the information during a court-martial of a military officer, Lt. Col. Terrence Lakin, who challenged his deployment orders on the grounds Obama may not be a legitimate president. Lakin was convicted and sent to prison.

    A year ago, polls indicated that roughly half of American voters were aware of a dispute over Obama’s eligibility. Recent polls, however, by organizations including CNN, show that roughly six in 10 American voters hold serious doubts that Obama is eligible under the Constitution’s demands.

    Orly Taitz, the California lawyer who has worked on a number of the highest-profile legal challenges to Obama, was encouraging residents of other states to get to work.

    “We need eligibility bills filed in each and every state of the union … as it shows the regime that we are still the nation of law and the Constitution, that the Constitution matters and state representatives and senators are ready to fight for the rule of law. During the last election there were some 700 more Republican state assemblyman elected all over the country, as the nation is not willing to tolerate this assault on our rights and our Constitution any further,” she said.

    There also was, during the last Congress, Rep. Bill Posey’s bill at the federal level.

    Posey’s H.R. 1503 stated:

    “To amend the Federal Election Campaign Act of 1971 to require the principal campaign committee of a candidate for election to the office of President to include with the committee’s statement of organization a copy of the candidate’s birth certificate, together with such other documentation as may be necessary to establish that the candidate meets the qualifications for eligibility to the Office of President under the Constitution.”
    The bill also provided:

    “Congress finds that under … the Constitution of the United States, in order to be eligible to serve as President, an individual must be a natural born citizen of the United States who has attained the age of 35 years and has been a resident within the United States for at least 14 years.”
    It had more than a dozen sponsors, and while it died at the end of the last Congress, there are hopes the GOP majority in the House this year will move such a plan forward.

    Breaking: American Missionary, Nancy Shuman Davis, Fatally Shot in Mexico

    (CNN) — An American missionary was fatally shot in Mexico on Wednesday, police said.

    The preliminary investigation indicated that Nancy Davis, 59, and her husband were traveling on a Mexican highway near the city of San Fernando, Mexico, when they were confronted by gunmen in a black pickup, the Pharr Police Department in Texas said in a statement. San Fernando is south of the border city of Reynosa in Tamaulipas state.

    “The gunmen were attempting to stop them and the victims accelerated in efforts of getting away from them,” the police statement said. “At a certain point the gunmen discharged a weapon at the victim’s vehicle and a bullet struck the victim Nancy Shuman Davis on the head.”

    Davis’ husband, identified as Sam Davis by family friends, drove their truck “at high rate of speed” to the Pharr International Bridge, which crosses the Rio Grande. Nancy Davis was taken to a hospital in nearby McAllen, where she was pronounced dead about 90 minutes later.

    Good evening, my name is Congresswoman Michele Bachmann from Minnesota’s 6th District.

    I want to thank the Tea Party Express and Tea Party HD for inviting me to speak this evening. I’m here at their request and not to compete with the official Republican remarks. The Tea Party is a dynamic force for good in our national conversation, and it’s an honor for me to speak with you.

    Two years ago, when Barack Obama became our president, unemployment was 7.8 percent and our national debt stood at what seemed like a staggering $10.6 trillion dollars. We wondered whether the president would cut spending, reduce the deficit and implement real job-creating policies. Unfortunately, the president’s strategy for recovery was to spend a trillion dollars on a failed stimulus program, fueled by borrowed money.

    The White House promised us that all the spending would keep unemployment under 8 percent. Well not only did that plan fail to deliver, but within three months the national jobless rate spiked to 9.4 percent. It hasn’t been lower for 20 straight months. While the government grew, we lost more than 2 million jobs.

    Let me show you a chart: Here are unemployment rates over the past ten years. In October of 2001, our national unemployment rate was at 5.3 percent. In 2008 it was at 6.6 percent. But just eight months after President Obama promised lower unemployment, that rate spiked to a staggering 10.1 percent. Today, unemployment is at 9.4 percent with about 400,000 new claims every week.

    After the $700 billion bailout, the trillion-dollar stimulus, and the massive budget bill with over 9,000 earmarks, many of you implored Washington to please stop spending money that we don’t have. But instead of cutting, we saw an unprecedented explosion of government spending and debt. It was unlike anything we have seen in the history of the country.

    Well, deficits were unacceptably high under President Bush, but they exploded under President Obama’s direction, growing the national debt by an astounding $3.1 trillion.

    Well, what did we buy? Instead of a leaner, smarter government, we bought a bureaucracy that now tells us which light bulbs to buy, and which will put 16,500 IRS agents in charge of policing President Obama’s health care bill.

    Obamacare mandates and penalties may even force many job creators to just stop offering health insurance altogether, unless of course yours is one of the more-than-222 privileged companies or unions that has already received a government waiver under Obamacare. In the end, unless we fully repeal Obamacare, a nation that currently enjoys the world’s finest health care might be forced to rely on government-run coverage. That could have a devastating impact on our national debt for even generations to come.

    For two years, President Obama made promises just like the ones we heard him make tonight. Yet still, we have high unemployment, devalued housing prices and the cost of gasoline is skyrocketing. Well here are a few suggestions for fixing our economy:

    The president could stop the EPA from imposing a job-destroying cap-and-trade system.
    The president could support a Balanced Budget Amendment.
    The president could agree to an energy policy that increases American energy production and reduces our dependence on foreign oil.
    The president could also turn back some of the 132 regulations put in place in the last two years, many of which will cost our economy $100 million or more.
    And the president should repeal Obamacare and support free-market solutions, like medical malpractice reform and allowing all Americans to buy any healthcare policy they like anywhere in the United States.
    We need to start making things again in this country, and we can do that by reducing the tax and regulatory burdens on job creators. America will have the highest corporate tax rate in the world. Think about that. Look no further to see why jobs are moving overseas.

    But, thanks to you, there’s reason for all of us to hope that real spending cuts are coming. Because last November you went to the polls and you voted out big-spending politicians and you put in their place great men and women with a commitment to follow our Constitution and cut the size of government.

    I believe that we are in the early days of a history-making turn in America. Please know how important your calls, visits, and letters are to the maintenance of our liberties. Because of you, Congress is responding and we are just starting to undo the damage that’s been done the last few years. Because we believe in lower taxes. We believe in a limited view of government, and exceptionalism in America. And I believe that America is the indispensable nation of the world. Just the creation of this nation itself was a miracle. Who’s to say that we can’t see a miracle again?

    The perilous battle that was fought during World War II in the Pacific at Iwo Jima was a battle against all odds, and yet this picture immortalizes the victory of young GIs over the incursion against the Japanese. These six young men raising the flag came to symbolize all of America coming together to beat back a totalitarian aggressor.

    Our current debt crisis we face today is different, but we still need all of us to pull together. But we can do this. That’s our hope. We will push forward. We will proclaim liberty throughout the land. And we will do so because we the people will never give up on this great nation.

    So God bless you, and God bless America.

    I’m a lurker here, but thought I’d respond to Debbie G.’s post about the 1790 law since, for some time, I’ve been reading original documents, records, letters and diaries of the early years of our country and those who were intimately involved.

    That phrase, from the 1st Congress, 2nd Session, is from a bill that passed regarding naturalization. Included at the end of the bill are a couple of lines regarding children born overseas or outside the limits of the US to citizen parents.

    That portion, in its entirety, states: “And the children of citizens of the United States, that may be born beyond sea, or out the limits of the United States shall be considered as natural born beyond sea citizens: Provided that the right of citizenship shall not descend to persons whose fathers have never been residents in the United States: Provided also, That no person heretofore proscribed by any state, shall be admitted a citizen as aforesaid, except by an act of the legislature of the State in which such person was proscribed.”

    In fairness to the original author of the article Debbie quoted, I found slightly different phrasing from different sources, all from that same era and all merely records of that Congress. However, the essence of the bill didn’t change. The Act was passed on March 26, 1790.

    Through the years, naturalization laws have undergone changes, which for my purposes are irrelevant. I wanted to know exactly how the founding generation defined ‘natural-born citizen’.

    I have also read the House and Senate debates regarding this bill. The debates focused on the naturalization requirements, but several times, natural born was mentioned, just as an aside that the bill took care to protect the children of citizens born elsewhere. Apparently, there was no misunderstanding among the members of Congress regarding the definition of a NBC. There was certainly no debate on the meaning.

    What I also found interesting in the phrasing of this bill is that being born on the soil is not enough. Perhaps later, other Congresses felt being born on the soil was essential to NB status, but the addition of such safeguards (if that happened, I’m not done with reading all the later changes and debates)would not negate the primary requirement for a child to be natural born–two parents who were citizens–nor would such an addition change the essential nature of the concept. The most important understanding is the one the founding generation held since they are the ones to place that requirement in the Constitution.

    It’s worth noting as well, that a child born on US soil did not automatically gain citizenship if the father (both parents in reality) was not a citizen. If that had been the case, it would have been spelled out in the Act, but it references the children, under age 21, following the father’s citizenship. The last line of that clause states plainly, as well, that naturalized citizenship must be granted, under the Act’s provisions, by state legislatures.

    We also know that during that era when a woman married, she took her husband’s name and his citizenship, if different from hers. A man who went to England and married an English woman would bestow on her his citizenship. Any children born in England would be natural born, because both parents were US citizens, even though she had never been to the US. However, the child, if he never came to the US and married in England, their children, because of the residency requirement, would NOT be a citizen and certainly not a NBC. Citizenship either continues or extinguishes itself in the next generation.

    The converse is true of a female US citizen who married an English man. She would become a British subject. That’s just the way it was and predicated on the prevailing belief of the time about the man as the head of the household and the preservation of the family unit.

    We don’t follow the marriage and citizenship rule anymore, but that doesn’t change the definition of an NBC. Due to the 14th Amendment, one parent and born on the soil is enough to provide citizenship and under certain circumstance, children born overseas to a one-citizen union, but it does not alter what constitutes natural-born status and nowhere within the 14th Amendment does it pretend to do such, nor is any such idea floated in the debates regarding the amendment. The concern at the time was over the Constitutionality of the amendment and the usurpation of states’ rights. It was meant to combine with the 13th Amendment in the cause of Civil Rights for the newly freed slaves. The framers of that amendment were clear that birth on the soil was not enough for citizenship (once removed from the citizenship of the freed slaves)as noted above in a post.

    All in all, NBC boils down to basics: It’s a condition at birth that cannot be altered by legislation or its meaning is destroyed. And, its meaning has not been legislatively altered, but spun through the promotion of ideas outside the intent and definition. Both parents must be citizens, naturalized or by birth, to bestow natural-born status on their offspring. Birth on the soil is not enough.

      I read this last night and am appalled that these threats and intimidation tactics are out there for all to see—this is terrorism — home grown–there you go nappy–arrest barry for this and his cronies too.

      Of course we here all know that barry is ineligible–and have been screaming about this for 3 yrs now, and now this news breaks—and no one is still going to stop it? What more is he hiding—this just proves he is illegal–what other threats are coming–the red button on americans? Something tells me it wouldnt be beyond him to do that.

    The Texas Senate has passed, by a 19-to-11 margin, voter photo ID bill that is now on its way to the Texas House. The bill, which will likely pass the House and be signed into law, will require voters to present a voter ID when they come to the polls.

    Below is part of a post from American Mercenary site. It has 2 VERY impertant points.

    Col. Boyd wrote about how hard it was to bring down Migs even with the six 50 caliber machine guns on the Saber, but as long as the pilot could use his maneuverability advantage to get where the Mig pilot couldn’t see, eventually any decision the Mig pilot made would be irrelevant to the outcome of the dogfight. The very minor detail of cockpit design from an engineering standpoint became a very significant tactical advantage.

    Facing a modern government insurgent have to be masters of “fast cycle” operations to stay inside of the OODA loop of the .gov. In the movie “The Next Three Days” Russel Crowe writes 15 and 35 on his wrist to remind him how long it will take the .gov to shut down the city center and then the city periphery. This is a very good example of a concrete reminder of the short reaction time that someone seeking to do something of which the .gov disapproves has to successfully complete their operation.

    Now back to an insurgency. Fast cycle operations have to be complete before all the technological might of the .gov can be brought to bear. Short, quick, raids are a good example. As are IED attacks. Something that causes the .gov to go “huh?” and commit assets to respond. Insurgents have to be gone before the UAV/Helicopter/Spyplane flies overhead and begins directing the movement and maneuver of ground forces.

    Point 1-Find any tactical advantage, no matter how small, and exploit it.

    Point 2-Speed. .gov is fast, but it takes some time to mobilize a response team. Strikes must be fast, hard and merciless. If you linger for a moment to long…you will die.

    Hmm-it appears to me that the Egyptians are standing up — which is what we should do. The cops and military are standing down and taking sides with the protesters and barry is calling their prez and telling them to make human rights a priorty ( yeah right )— and in the same breath he is dictating that the US will lower its foreign aid…

    Seems like these people have decided what the will of the people will be—and not the govt. The govt is standing down! That is Awesome news….and again we the people of the US should follow suit…..right on the steps of the white house–I guess those theives over there are afraid of the masses of people coming together — more of them, less of the govt!!! LOL…Go Egyptians!
