Wait a minute. { Shakes head.}

Everyone keeps playing the game of “fighting” Barack Obama’s “laws” when by law, nothing that the illegal Barack Obama signs is legal.   It is void, can’t be enforced, inapplicable. 

He cannot meet the test of natural born citizen, can’t prove he was born in Hawaii, and gets by with a stolen social security number and forged selective service registration.  And everyone knows it.  Proving again that they are complicit in the fraud committed on the American people of installing Barack Obama.

But they are all compromised like John Roberts and many more could be criminally indicted. So they will make the choice to betray their country to save themselves.

The failure to hear and properly address Obama’s lack of Article II eligibility results in the violation of  our civil rights  under Title II,  Section 1983  with the highest court in the land now a clear and present danger instead of a clarifying voice and protector of the Constitution’s separation of powers.  As it turns out, every single member of the judiciary is compromised as their jobs depend on the current regime being in place; that fact in itself is a violation of our civil rights.

As Ann Barnhardt said, the proper response is “junta” but that is not likely.

Short of the arrests that should happen by responsible military, FBI, or law enforcement, or the revolution itself beginning prematurely,  let’s propose a different scenario.

In walk the plaintiffs as themselves and file a Title 42 action against the latest federal judge to dismiss an eligibility case:

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.

Invoking Rule 38 of the Federal Rules of Civil Procedure, the plaintiffs demand a jury trial:

(a) Right Preserved. The right of trial by jury as declared by the Seventh Amendment to the Constitution—or as provided by a federal statute—is preserved to the parties inviolate.

The evidence is finally heard by a jury of regular citizens who conclude the judiciary has conspired with the Obama administration to repel lawful citizen petitions, resulting in a violation of the civil rights of these plaintiffs and all Americans.

Assuming it is framed properly, what is the remedy requested by this hypothetical legal action? How is it enforced?

    Oh wow, Dr. K. out of the ball park.
    What judge or AG can we get to call for a Grand Jury? Surely one of them would be willing? How about the lady AG from Florida, she seemed properly ticked, or Ken from Virginia?
    They say we have to be injured to have standing, so where from here?
    I know we have some legal beagles posting here, what is our solution?

    Also, since one part was thrown out and another part was re-written by Roberts, the whole thing should be null and void because there was no severability clause. Gretta spouted that for months before Roberts ruled, now she is silent on it.
    I would like to hear what Judge Napolitano has to say. Or has he already and I missed it?

      SCOTUS has the power to override the lack of that clause, and by ruling the way they did, they implicitly ruled that the lack of the clause is immaterial.

        Disagree. The severability clause is one of the reasons the AZ immigration law stood despite knocking down two important pieces of the law.

          Yes, but the situation is the reverse here. There is no severality clause, so the document does not say what happens if a part is invalid. That issue is left open. So because it is open, SCOTUS has the power to keep part of it or scrap it totally.

            The rule is when there is no severability clause, any aspect of legislation that is found unconstitutional negates the whole law, there are no ‘instructions’ that parse out anything if the severability clause is not included. Its a rule. The lack of a severability clause was a political ploy, imho–to make the Supremes say ‘all or nothing’, which could then be used as a political issue. But Roberts avoided that by rewriting the bill–which is NOT in the supreme court’s power.

            Roberts did something completely different and rewrote the law. That has not been done before, and the dissenting justices point that out. Since he rewrote the law as a tax, not under the commerce clause, he found it ‘constitutional’ under Article I taxes, which then is another avenue to challenge the law because the tax will have to be uniform, which right now it isn’t because of the waivers.

            Nazi Roberts betrayed America because like the skull and bones boys, they think they can traffic in children, money, drugs, and guns without impugnity. And, they choose their own personal careers over their sworn oath of office.

            This America is lawless now. If Obama can usurp the presidency without impunity, then why should anyone follow laws or precedent? Roberts obviously didn’t feel he had to. But he’s the one who swore in Obama, so he is trapped as he should be booted and jailed right along with Obama for insurrection against these United States.

              Obviously, I fully agree with you about the dishonesty of Roberts, the entire SCOTUS, and the whole Judicial Branch, not only regarding this case, but regarding other cases as well. It is clear that they are violating their oaths they took to protect the constitution. Of course, I also agree that Roberts is not entitled to rewrite it, and tax-excuse fits a political hack not a chief justice.

              About the rule you are referring to, I am not sure. If it is not much trouble, could you reference it so I can read it? I want to convince myself that it is binding on SCOTUS, not only on the lower courts.

              If you are right the opponents of O’Care would and should raise hell, demanding that Congress corrects the situation as they should. However, I don’t hear sufficient amount of noise from that direction. (Which could be my fault; perhaps I don’t have time to listen). Or it could be that critics (of that single issue) have changed their minds, and silently agree that SCOTUS has such power.

                  The link you provided was written before the SCOTUS-ruling and it assumes that the Individual Mandate part will not survive. There is nothing in this article that enlightens us about the rule you were referring to. I could not find anything on that rule. So the question with regard to the “rule” is still open.

                  This is the only thing that I could find which does not answer the question but explains partially what they did:

                  “The Supreme Court only ruled on the two parts of the law that were specifically challenged: the individual mandate and the Medicaid expansion. These were the provisions that were most likely violative of the Constitution, so the rest of the act most likely would withstand constitutional scrutiny. ….States that do not agree with that transformative new Medicaid strategy cannot be penalized by taking away their existing Medicaid funding. Even though that provision was unconstitutional, the Court held that the provision was severable, and the rest of the act stands. ”

                  The Medicaid part is severable because it is a peripheral issue and removing it does not affect the rest of the act, so it is logical that they ruled that it was severable. Also note that they ruled only on the above mentioned provisions, not on the other provisions.

                  That does not mean that I agree with the rest of their ruling as I said earlier, but I remain unconvinced that a “rule” should have been used to declare the entire act unconstitutional due to the lack of severability clause.

                      The situation is sad.

                      The Executive Branch is rotten to the bone;

                      The Legislative Branch is so lethargic that the Minority Leader tells the members: Don’t read it just vote affirmative, when legislating a major-major law, which drastically affect every citizen’s life and 1/6th of the national economy. I bet the lazy b….rds still don’t know what is in it. The opposition party is incompetent, there is no real opposition.

                      The Judicial Branch, which in many citizens’ eyes is the last bastion of sanity and honesty, is behaving like political hacks instead of the ultimate protectors of the constitution.

                      None of the branches can be trusted. It seems like we are slowly descending in a dismal spiraling vortex, bringing the entire country lower and lower, month by month, to a dark unknown chaos, reminding one of images created by Dante.

        The situation is very difficult. Splitting the conservative vote now by establishing a third party viable for this election is too late, or impossible. So we may have to go with the incompetent GOP.

        But that the GOP has to be replaced by the 2016-election. We have to admit that the Tea Party is not an effective political force, and the hopes placed in it, were in vain. To a large extend the GOP is self-distracting by using the wrong policies or avoiding good ones, so the replacement may not be difficult.

        RP would have the stature to establish a new party, perhaps with Allen Keyes. (Don’t know if the two would get along, but you get the idea.) And, we hope that the Constitutional Republic will be still standing in 2016, which is questionable if the GOP loses now.

    The ACA bill (deathcare tax) is all smoke and mirrors. Right now I get to see the Docs assistant at my PCP’s office and not the doc. I can go to the docs if only I have a cold or flu they told me.
    Now my specialist sees me for 5 whole mins and the next appt I have is one year out unless I go in to see his nurses assistants or call on the phone for issues.

    Kick in the deathcare tax and I won’t get an appt with anyone, anywhere for up to 2 years. You neither. All I’ll get is a kick in the pants and more taxes taken out of my Pay that I earned from my labor…….

    Doesn’t sound that great does it?

    Maybe we won’t be able to get Dr appts at all. We’ll die before the appt.

    But then the emergency rooms will be jammed packed more than ever.

    So what does this stupid so-called health-care bill solve?

      cb radio for your car or home also a good idea…no license needed. Hand-held devices for local communication are also handy. You can home study for the license for shortwave radio operators licenses at several levels. I’d recommend everyone invest in one or more of these devices…if you are on the road a CB (citizens band) radio is handy. You’ll need a good antenna.

    One possible ending is that bho gets swept up in the Barkley (et al) bank investigation and enough info is brought forward by the Cold Case Posse together with several currently released books to finally raise a question regarding his “suitability” as a candidate—also, the lack of funding indicates his handlers are growing cold.
    Romney will be embarassed by his off-shore money dealings and his role in the misdirection of stolen Fed Res money.
    I don’t know who the Dem.s have as an alternate, but the obvious GOP guy is the second runner, Dr. Paul.

      hmmm. the change of the word ‘eligibility’ to ‘suitability’ gives everyone an out to work against or not vote for him without admitting they ignored the elephant in the living room (aka misprision of felony or treason), and admits other information (ssn, ssregistration, aliases, etc)…

      I keep leaning towards Ron Paul…and my scenario would include a complete economic collapse that would require a plan like Dr Paul’s to just prevent the ship from completely tipping over…as I see Obama, he’ll be trapped somehow–the nsa will finally catch him personally delivering false information he’s been fed by some spy inside his operations.

      The real Mitt is beginning to show totally–he is plastic and has inappropriate responses at times, like smiling when saying the Obamacare is a ‘tax’…?

      Hillary is the obvious back up nominee. But it looks as if O will continue to be the nominee. He is beating Romney in most polls. The Dems stepped up the personal accusation as expected, and they have not even thrown in most of the $1 B campaign fund they have, yet.

      Romney, in spite of Trump’s advice, refuses to fight back that way; he is following McCain’s gentlemanly strategy. Ergo, he will lose, probably even against Hillary, in the unlikely event that she gets the nomination.

    Another possible demise of bho is that things get worse for him and he declares martial law and the military –some portion thereof– don’t respond to the orders of a questionable Commander-in -Chief. No violence, just non-compliance and he is rendered “unsuitable” to continue.

    I saw this article this morning and decided I should respond–here is what I wrote.

    Dear AP,

    Why is it when you write an article of any kind you never include the basic truth behind the cause?

    The Yosemite Nat’l Park Bridge article is vague to say the least and when you write, do us all a favor and print the culprit .

    Why not just tell the people of the US that the UN is behind this activity and the removal of these bridges under the guise of AGENDA 21!

    This is going on all over the United States and the federal government is blaming it on envirormentialists when in fact it is the UN telling the people of America what we can and cannot do in our own country. Sure the feds will say its federal land and that will be their excuse to do this, but this country belongs to us—WE THE PEOPLE and we have the authority via our Constitution to put an end to this theft. So AP stand with America and the people of this great nation instead of the corrupt and criminal government causing our country to fail.

    We need to get the UN out of America and remove our country from their dictating claws.

It’s worse to be cold than hot and sending them to a warm island would be a vaca for them.       I believe unions may have served their purpose at the turn of the 19th century to the 20th when child labor was de rigueur and events such as The Triangle Fire were a result of horrific labor conditions (come to think of it, I recall learning about this event in school. And yet, propaganda or not, ite accident did occur.. However, the unions have morphed from a well intended effort into an anti American, Marxist movement. I abhor unions.

    Just heard that the Dems propaganda machine is now labeling Romney the “most secretive presidential nominee in US history” due to some tax or other records he is not releasing. This is not to defend Romney, but if the GOP does not hit back and cite the litany of documents O is blocking, costing him and the taxpayers big $s in legal fees, the GOP is doomed.

      Just watched an interview with Jack A. Abramoff. He says the things he served prison-time for are still going on big time. Pretty much in the same vein as your link.

      The constitution should not be touched, but the 2-party system does not work. The check and balance principle has been a theory only, for a long time.
