We are living through history in the making. Please read or re-read this historic Petition to the U.S. Supreme Court asking them to support and defend the Constitution … in particular Article II, Section 1, Clause 5, the presidential constitutional eligibility clause.

Then meditate on the words in both and then pray that the Justices do the right thing on Tuesday and support and defend our Constitution and Republic and grant Certiorari and take up our case and seek the truth about Mr. Obama the usurper, impostor, and fraud now occupying the Oval Office.
Mr. Obama and his puppet masters and his enablers in political power and in the main stream media have perpetrated and allowed to continue the greatest fraud on this nation in the history of our Republic and he needs to be exposed and removed. QUESTIONS PRESENTED TO THE U.S. SUPREME COURT:
PETITION 10-446
- Whether petitioners sufficiently articulated a case or controversy against respondents which gives them Article III standing to make their Fifth Amendment due process and equal protection claims against them.
- Whether putative President Obama can be an Article II “natural born Citizen” if he was born in the United States to a United States citizen mother and a non-United States citizen British father and under the British Nationality Act 1948 he was born a British citizen.
- Whether putative President Obama and Congress violated petitioners’ Fifth Amendment due process rights to life, liberty, safety, security, tranquility, and property and Ninth Amendment rights by Congress failing to assure them pursuant to the Twentieth Amendment that Obama qualified as an Article II “natural born Citizen” before confirming his electoral votes and by Obama refusing to conclusively prove that he is a “natural born Citizen.”
- Whether Congress violated petitioners’ rights under the Fifth Amendment to equal protection of their life, liberty, safety, security, tranquility, and property by investigating and confirming the “natural born Citizen” status of presidential candidate, John McCain, but not that of presidential candidate, Barack Obama.
Comments by CDR Kerchner (Ret):
Obama is not Article II constitutionally eligible to be the President and Commander of our military. Obama is NOT a “natural born Citizen” to constitutional standards. Obama’s father was NOT a U.S. Citizen. Obama’s father was not an immigrant to the United States. Obama’s father was a foreign national, a British Subject. Obama is the child of an alien father who was sojourning in the U.S. attending college. Obama was born a British Subject via his father and is still such to this day. Obama has never conclusively proved he was born in Hawaii. Obama’s paternal family in Kenya, Kenyan government officials, and newspapers in Kenya say he was born in Kenya. Obama’s maternal grandmother likely falsely and illegally registered him as born in Hawaii to get him, her new foreign-born grandson, U.S. Citizenship.
Chief Executives Can Be Removed from Office
History shows us that a popularly elected, but ineligible, chief executive in the executive branch of a government can be legally and constitutionally removed from office.
Governor Thomas H. Moodie of North Dakota was a prime example. After he was sworn in and serving as Governor, the North Dakota State Supreme Court ordered Governor Moodie removed from office, after it was determined that he was constitutionally and legally ineligible to serve in the office to which he was popularly elected.
Also, two U.S. Senators, although popularly elected and sworn in to the U.S. Senate, were subsequently removed from office after it was learned that they were NOT constitutionally eligible when they were elected.

Thus it is very clear that winning a popular election does not trump or nullify the constitution of a state or the U.S. federal constitution. Obama is not constitutionally eligible to be the President and Command in Chief of the military and should be removed from office and his election, confirmation, and swearing in annulled.
Again, please take the time to read or re-read the Petition then read this ad. The questions and the main brief are only 36 succinctly written and easy to read pages. Governor Palin is a courageous person, no doubt. In view of her massive following, if she would simply, briefly, tweet about the upcoming case before the US Supreme Court next week, it would change the course of American history.
November 23, 2010 marks a fork in the road for the future of America of more than historic proportions — perhaps on par with events leading to the Civil War. To date, virtually all federal and state courts where actions have been brought seeking decision on the meaning of the Constitution’s Article 2 “natural born citizen” clause as a prerequisite for Barack Obama to be a lawful President and Commander in Chief of the United States (Mr. Obama having been born to a father of British/Kenyan nationality and father not a citizen of the United States), have been shut down, never getting beyond the issue of standing. To date, courts have very strategically (narrowly if not artfully) characterized and applied law and legal procedure steadfastly to prevent the question from ever rising to the merits — this on a host of different types and classes of plaintiffs, causes and defendants — admittedly under the most intensely implicit (if not more) pressure to do the same.
The national media (some say our 4th branch of government) has aided and abetted the avoidance by mischaracterizing this as a “Hawaii birth” a/k/a “birther” issue which is nothing more than a “red herring” in that the issue for Article 2 “natural born citizen” is Mr. Obama’s father. Moreover, the legal community has aided and abetted the avoidance by mischaracterizing the 1898 Supreme Court Case, Wong Kim Arc, which dealt with the meaning of “citizenship”, not the meaning of “natural born citizen” under Article 2.
November 23, 2010 may very well be the last chance for the Judicial Branch realistically to take up the issue, this on a case of legal standing solidly presented by Attorney Apuzzo and Commander Kerchner. If the Court finds no standing here, by a narrow interpretation of the same or otherwise, coming after all the rest of the “no standing” cases, it is doubtfull this important Constitutional issue can and will be resolved in any court of law. The question will nevertheless continue to fester, at tremendous national cost, never to abate, potentially to reach crisis stage, and in any event to undermine the structure of our Constitutional Republic.
It is more than chilling and says volumes that NOT ONE member of Congress will publicly speak on this or, better yet, since the Congress of the United States has more than a vested interest, opine if not as a “friend of the court” at the Supreme Court, in the court of public opinion — BEFORE the Supreme Court convenes on November 23, 2010.

I have watched this video many times. Mr. Keyes deftly articulates the truth of the illegal evil fraud of Obama, yet the elitist MSM propaganda machine was somehow able to completely marginalize Mr. Keyes. Sadly, he is a modern day political “Cassandra” whose pre-election warnings were completely ignored.
Probably most, or at least many, readers here were naively like I was in those pre-election days — certain that in the end, the rule of law would trump the hysterical mass infatuation with the chameleon candidate. I was astounded that so many of my fellow citizens would embrace such an obviously unqualified usurper, regardless of his degeneracy and core hatred for most all of what made America so great (which, as repugnant as they were, were merely political disqualifiers).
I pray that the SCOTUS has the courage to uphold its sworn duty and finally protect our Constitution and the rule of law, any economic/monetary threats from George Soros notwithstanding (I believe the American people have the wherewithal to deal with whatever trouble Mr. Evil-incarnate may dish out). Come January, when the lame ducks are finally cooked, we should arrest Soros, convict him of economic terrorism, seize all his assets and send a clear message to all the other new-world-order control freaks that we are free and proud people and will never submit to their unjust shackles.

Sorry for my poor documentation, but I am in a hurry. If memory serves me right, Wikipedia had a link on their birth certificate page leading to a general discussion on identity. The author said that a birth certificate is not the end-all of identity checks. There is no law that says birth certificates trump all else. Government documents that I have see confirmed this. In fact, it is the preponderance of all evidence that leads to a decision on identity. In other words, even though Hawaii now uses a computer generated birth certificate, the US government does not have to rely on it alone. The US government can and should look at all documents, preferably original documents, in cases of national importance. I think the CIA must work this say. Why does Congress think it can slid on their responsibility?

Dear drkate-Thank you for that informative video re: Richard Epstein. All this regulatory nonsense is just a drag on everything and I have yet to see that any meltdowns, or Bernie Madoff type scams were prevented-the crooks seem to find ways of avoiding or doctoring paperwork than anyone can track it, which they always find out after the horse left the barn.

My pleasure, Papoose. I don’t post often as you can probably tell, but I do follow passionately. This is so egregious to me. I can remember sitting in history class and being engrossed in early American History.
And I can certainly remember being taught the Constitution and memorizing the preamble “We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America”.
And I was taught exactly what the qualifications for President, Vice President, Senators and Representatives were. (Thank you, Mr. Stoddard, wherever you are.) I just wish I could find a copy of my history book as I’m sure the definition of Natural Born Citizen is right there as plain as day. Never a doubt in my mind as to what it mean(s)t.
Dr. Kate, how will we know the outcome of the Supremes’ decision today? I’ll keep checking here and on the Kerschner and Apuzzo web sites.

Wow, Dr. Kate, that is some article! He brought out some things I had never thought of. Mario certainly is a very brave and honorable patriotic American. Not to diminish Cmdr Kerchner at all, of course. Mario Appuzo absolutely does rank up there with John Adams and the other founding fathers.
Nancy, I agree. I am so proud of Mario and Charles…an incredible story, Kerchner went through 30 people before he found Mario–and Mario has done all of this work PRO BONO!
I am so happy Lame Cherry picked this up…it means a lot…I have that same respect for Mario…his case, the integrity the lack of fan fare…etc.
