How appropriate that on the day that Obama pretends to sign into law an unconstitutional, hostile take over of America, his Achilles heel snaps up right in front of him. By now many of you have likely had time to read Attorney Mario Apuzzo’s outstanding Appellant’s Reply Brief filed today with the U.S. 3rd Circuit Court of Appeals in Philadelphia PA. The closing two paragraphs sum up the issues and consequences and the duty of the federal court’s role in resolving the core constitutional legal question of this lawsuit very well. Imo, Atty Apuzzo’s words will live in history. The federal courts must take this case or our Constitutional Republic is doomed and on its way to the scrap heaps of history.
Atty Apuzzo writes on pages 29 & 30:
“The Supreme Court has warned us what can happen to our republic if its government does not observe the laws of the land. United States v. Olmstead, 277 U.S. 438 (1928). A finding of no jurisdiction will mean that we as a nation accept usurpation and tyranny by a small group of individuals who can act in concert and gain control of both parties and overthrow the constitutional order of our Republic and that citizens of the United States such as the plaintiffs, whose life, liberty, safety, security, tranquility, and property are threatened by such a plan and action, do not have any due process to protect themselves through a legal action in which they ask the judicial branch of government to protect them by enforcing the Constitution.
Judicial review is absolutely necessary when the other two branches of government act in a concerted way to subvert and ignore the Constitution’s requirements defining eligibility standards for the most powerful office of the land, the President and Commander in Chief of the Military. This power balance is important to the survival of our Republic and our Constitution. Plaintiffs’ case goes to the very core of our Constitution, the fundamental law of our land, and whether ultimately our legal system truly means anything when it comes to controversial but critical constitutional issues. Bravo-Zulu Mario! You have done your job well. In your various briefs you have given the courts the facts and correctly cited the laws of our nation, including the Constitution which is the fundamental law of the land. The decision is now in the hands of the Appellate Court. They must now do their duty in our constitutional system of checks and balances and use their judicial review powers granted to them by We the People in the Constitution, and confirmed by the great Chief Justice John Marshall, to prevent usurpation of power by the other two branches. May they look for guidance to God, the Declaration of Independence, the Constitution, the Federalist Papers, and the U.S. Supreme Court decisions you cited in your Appellant’s Opening Brief and other briefs, and then do the correct thing per their oath “… to support and defend the Constitution of our United States against all enemies foreign and domestic … so help me God”, and remand the case back to the District Court for a trial on the merits so we can learn before the bar of a court of law the true legal identity of Obama and reveal what he has been hiding from the American people, that he is not an Article II “natural born Citizen” to constitutional standards. And in doing so, We the People will remove the Usurper from the Oval Office.

I kinda hate to say this straight out, and in no way should it be taken as marginalizing Mario’s effort, but it seems obvious to me that the entire Judiciary is in the tank, right along with the others. I think they are in the tank too. But Mario’s brief is the best and most thorough of all the cases…it is brilliant. And the failure of the judiciary to address this case will be outrageous as it is so clear they must address it. All eyes are on the judiciary now.
The efforts of Cmdr Kerchner and Atty Apuzzo are very impressive and should be appropriately addressed by the courts. Whether that happens remains to be seen. However, the natives are indeed getting restless what with the various law suits of states (particularly Virginia’s).

Yep. Recently, some leftist member of Congress accused talk radio hosts of accusing Obama of trying to set up some kind of caste system, with blacks at the top. I don’t remember the exact phrase used, but that’s close. Nobody remembers anyone ever saying this on the radio. This so-called representative is the one who brought it up. But this is one of their usual Alinsky tactics: Raise the specter of exactly what you’re doing and then criticize opponents in advance, so that if they do call you out on it, it’s already firmly established that to criticize is to be RACIST. Head them off at the pass. Make sure it’s firmly situated in the country’s psyche that even to suggest that Obama intends such a regime is racist, although the plans themselves are what’s racist. And this is very close to what he wants to do through his redistribution schemes.

I am not sure the founding father’s would have agreed with Beck. I am not a violent person and I do not own a gun but I am constantly wondering what the likes of Glen Beck mean when they say “Wake up America?”. I mean what more can people do? The ‘weakness’ is Article V, it’s self amendment. But the article does not notice that the states have to approve the amendment, that Congress can only propose it. No law can over turn it.

From what I understand, Glenn is launching a new way that we can fight back against this tide of Marxism this Saturday. He has also started a kind of “Beck’s University” at his insider website. I haven’t joined yet (think it’s only $6.00 a month), but I plan to do so in order to learn what he is teaching at the event being launched this Saturday (in Florida? I think?).
I don’t think that Beck is advocating that we don’t defend ourselves with weapons (after all, he owns several and is licensed to carry a concealed weapon). What he is trying to get across is that VIOLENCE is NOT the answer!

I think that Glenn is right that we need to inform those in the public who are oblivious to what is REALLY going on. Glenn’s radio audience is estimated at 8 million and his t.v. show is estimated at 3 million. If each person shares this information and wakes up just ONE, or two, or three neighbors, friends, relatives, or acquaintances, then we would could reach an additional 11 million to 33 million people.

Yes, I do love it here. My hopes and wishes are, that we the people will continue to have the net. If what’s his name gets his way, like he is talking about, his plan to shut it down.
Then where will we go for our news sources. We get everything we need right here. No MSM on in my house and fox is on for a few hrs at night. So talk radio and this site and others are so important.

Again today I spoke with my congressman’s office about our AG who is sueing one day and not the next, being a dem he can’t make up his mind. After a long conversation with the aide, I decided to immediately call the AGs office. Get this, a little girl answered and asked what I wanted so I said to talk to so and so and she had been instructed to pass me through to their “message complaint center”– a recorded message. Well I left a message, saying that I am a conservative but have voted a split prior, and demanded that he support all of the AGs lawsuits regarding the HC bill. If he did this I would consider giving him my vote in Nov since he is running for Gov!!!!—————not a chance in hell would I vote for him–but he doesnt know that!
A few hours later on the local radio station, a reporter announced that the AG was seriously considering entering the lawsuit! Sometimes we just gotta do what we gotta do!!

On the Glenn Beck show today he said that today Social Security has NO MONEY AT ALL! Just a few days ago it was announced that they would be solvent through 2018————so Beck said what I said, where did that money go between a few days ago and today.
